The Foodies Dinner Party Experience

Please read and understand the following terms and conditions as they are binding for all ticket purchases.

 

By purchasing the ticket, you (“Ticket Holder”) agree to be bound by the Terms and Conditions of sale specified herein and any other provision as may be specified from time to time by TribeUpp. TribeUpp shall not be liable for any death, personal injury, loss, damage, however, caused while in the venue, location or place related to TribeUpp. All TribeUpp experiences are live events and therefore once the booking is confirmed, refunds and cancellations are not accepted. Changes can be made to a booking up to 5 days before the event. Any refunds shall be made only at TribeUpp management’s discretion. Tickets are sold subject to the following conditions:

 

  1. You have expressly agreed to participate, join, use, play and/or access TribeUpp at your sole risk. To the fullest extent permissible by applicable law, TribeUpp disclaims all warranties, express or implied, including but not limited to, implied warranties, merchantability or fitness for the operation of the TribeUpp experiences. TribeUpp does not warrant the reliability, accuracy, completeness, current or error-free of the product, content and materials included, used or deployed within the experiences. If a product, content or material is not as described, you have expressly waived the right to claim damages and/or losses including but not limited to direct, indirect, incidental, punitive, and consequential damages derive from such use or reliance of the description of the product, content or material.
     

  2. All items including but not limited to your personal belongings, stuff, object, luggage, baggage, watches, wallet, item and/or property, shall be kept by you at your sole risk. In any event, TribeUpp shall not be held liable or responsible for any loss or damage of your personal belongings during the experience. The risk of loss for your personal belongings shall be borne by you upon commencement of TribeUpp experiences. 
     

  3. To the fullest extent permissible by applicable law; TribeUpp shall not be responsible for any risk, hazard, danger, security, threat, safety and/or protection for TribeUpp experiences. You shall be solely responsible, answerable, accountable for your personal safety, security, body condition, disease transmission, pregnancy, health condition, while you participate, join, use, play and/or access TribeUpp experiences. TribeUpp hereby expressly warn, caution, advise, inform and/or notify that the TribeUpp experiences may be dangerous, hazardous, risky and unsafe, insecure to you and you shall be duly informed, notified and understand the underlying danger, risk, hazard of the TribeUpp experiences.
     

  4. You undertake to behave, conduct, perform, carry out, execute, achieve and complete the TribeUpp experiences in accordance with the instruction, command and rules specified by TribeUpp. Failing these TribeUpp shall have the right and power to decline or refuse your participation in the experiences. 
     

  5. You shall not be allowed to record, capture or snap any photograph, video, film, audio recording of TribeUpp materials whatsoever before, during and after the TribeUpp experiences save and except with the explicit permission of TribeUpp and if it is needed for the TribeUpp experience and/or task to be played.
     

  6. You undertake not to carry or bring any dangerous, harmful or hazardous object to the experiences including but not limited to sharp objects, explosive items, weapons or items deemed to be dangerous or harmful to other visitors during the experience. In the event, if such item or object is found, TribeUpp shall have the power, authority and consent expressly granted by you to remove and confiscate such item or object and further decline or refuse your participation in the experiences.
     

  7. You shall not commence the game under the influence of drugs or intoxication, failing this TribeUpp shall reserve all rights and power to decline or refuse your participation in the experience. If you are found to be under such influence, TribeUpp have the power, authority and consent expressly granted by you to remove and confiscate such alcohol, drug or liquor without any compensation, remedy or damages and shall reserve all rights and authority to take the necessary legal action to ensure the reputation of TribeUpp experiences remain intact and guard against any risk or harm towards TribeUpp. All losses, damages or legal costs derived from such incidents shall be solely borne by you. 
     

  8. You shall be responsible to wear the proper and suitable attire including but not limited to footwear and clothing before the commencement of the TribeUpp experiences.
     

  9. TribeUpp holds the explicit rights to cancel an experience if there are not enough participants to create a team. Each experience has different minimum numbers, which are outlined on TribeUpp’s website. TribeUpp holds the right to cancel an experience up to 24 hours before. If TribeUpp cancels an experience you can accept a refund or reschedule to the next game happening.
     

  10. The website www.tribeupp.com is owned and operated by TribeUpp Limited. The company holds the right to amend or vary these Terms and Conditions including any of the contents of the website from time to time at its sole discretion without prior notice.
     

  11. The experiences are designed for 6 participants to participate at the same time. TribeUpp holds the right to amend or vary the teams and team roles at their sole discretion without prior notice.
     

  12. TribeUpp expects its participants not to disclose any details of the experience riddle/clue answers directly or indirectly to the public.
     

  13. TribeUpp is entitled to charge the participant for any damage or loss of HOP cards and game materials, which is intentional or caused by misuse or loss of items.
     

  14. Since some TribeUpp experiences are outdoors and using public spaces, you must ensure to conform to our codes and regulations, adopt proper standards of behaviour and cooperate with our employees having security responsibilities. 
     

  15. TribeUpp doesn’t tolerate any kind of bullying or harassment towards its other participants, public and employees. TribeUpp shall reserve all rights and power to decline or refuse your participation in the experience. 
     

  16. If you wish to transfer your Game Ticket into someone else’s name, you must contact TriebeUpp by either email or telephone at least 24 hours before the start of the game. TribeUpp may refuse this facility.
     

  17. Experiences may not be transferred or resold for commercial purposes or at a premium. If an Experience is transferred or resold in breach of this condition, the bearer of the Game Ticket or the person claiming the right to attend the event will be refused admission to the experience.
     

  18. You acknowledge and agree that, by accessing or using the TribeUpp website or services or by downloading or posting any content to or from the TribeUpp website you are indicating that you have read, and that you understand and agree to be bound by these T&Cs. If you accept or agree to these T&Cs on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these T&Cs and, in such event, ‘you’ and ‘your’ will refer and apply to that company or other legal entity. 
     

  19. By registering with TribeUpp you agree to adhere to (i) public policies published by TribeUpp on the TribeUpp websites (such as the Privacy Policy), and (ii) the ‘Participant’s Charter’ in respect of any TribeUpp experience you purchase a ticket for. You may cancel your registration at any time. If you cancel your registration we shall delete all personally identifiable information to the extent required to comply with applicable laws. You accept that we may terminate any user’s registration at any time. 
     

  20. Registration and access to the TribeUpp experiences are intended solely for persons who are 18 or older. Any access or use of the TribeUpp website or TribeUpp experiences by anyone under 18 is expressly prohibited. By using the TribeUpp website and TribeUpp Experiences you represent and warrant that you are aged 18 years or older. 
     

  21. You agree to complete the registration process honestly and as completely as you are able, and to keep the registration and other information about you accurate and up-to-date. You may not register as a TribeUpp participant on behalf of an individual other than yourself. Your registration with TribeUpp is personal to you and may not be sold or transferred without TribeUpp’s prior written agreement. Your details can be amended/deleted by emailing us directly at hey@tribeupp.com
     

  22. You agree to provide the following obligatory information in your ‘Registration’: Your family name - Your first name - Your email address - Your phone number - Any allergies you have - Suburb you live - Gender - Profile photograph.
     

  23. You will need to agree to our payment provider’s terms and conditions when you register to make payments. 
     

  24. You receive the confirmation of your booking via email. TribeUpp is not sending confirmation via post or text message.
     

  25. A booking becomes a no-show and participation will be declined if you are late 10 minutes or more. In such a situation, the money is not refundable and the booking is not changeable. 
     

  26. Bookings can be made online on the TribeUpp website only.
     

  27. Full payment is required at the time of booking.
     

  28. TribeUpp is a live event so once the booking is confirmed; refunds or cancellations are not accepted. 
     

  29. Each TribeUpp participant will be instructed before their experience by the assigned local GameMaster. After learning the rules of the experience, each participant will participate in the experience at their own risk. 
     

  30. Photos that are taken during the experience and sent to TribeUpp in accordance with TribeUpp’s permission during the experience, you give consent for TribeUpp to use these photos/videos for promotional purposes for example but not limited to use on social media and the TribeUpp website. If additional promotional photos, videos and audio are being taken during your game by the TribeUpp team, you will be notified of this and you give consent for TribeUpp to use these for promotional purposes.
     

  31. Prizes received at the end of TribeUpp experiences, cannot be redeemed for cash. If the prize is a full team prize it can only be booked for the team as a group. If individual members decide they do not want to participate, the remaining team members can still attend or accept the prize. If you wish to not participate in the prize, there are no cash refunds or alternative prizes. For the Expat Game Experience specifically, TribeUpp aims to offer 3 prize options, but TribeUpp holds the right to change the number and type of prizes at their sole discretion without prior notice. If the majority of the team cannot pick a prize, then TribeUpp may pick for them. The prize must be redeemed within 8 weeks of completing the game. If the prize is an individual prize, in that it is given to only one person in the group, the prize winner is not obligated to share with the rest of the team.
     

  32. The TribeUpp website and TribeUpp experiences, such as The Foodies Experience may comprise of a hosted event, where you will be expected to host Guests. You understand and agree to the ‘Participant’s Charter’ and that TribeUpp is not a party to any agreements between Hosts and Guests and that TribeUpp has no control over (and not liable or obligated to you in respect of) the conduct of (i) Hosts, (ii) Guests, (iii) other users of the TribeUpp websites and TribeUpp experiences or (iv) others attending or facilitating Hosted Events. You agree that TribeUpp is not responsible for any damage or harm resulting from our interactions with other users of the TribeUpp website or TribeUpp experiences and you accept that (to the maximum extent permitted by law) TribeUpp disclaims all liability resulting from the conduct of any such person. 
     

  33. By agreeing to these T&Cs you agree to adhere to all applicable laws and regulations (including without limiting the generality of this provision, fiscal and administrative regulations) that apply to any Hosted Event. 
     

  34. You agree that TribeUpp shall under no circumstances be held responsible or liable for any representation in a TribeUpp Hosted Event not running smoothly or as advertised or otherwise being unsatisfactory. 
     

  35. In certain circumstances, TribeUpp may decide, in its sole discretion, that it is necessary or desirable to cancel a Hosted Event. In these circumstances TribeUpp may determine, in its sole discretion, to refund to the Guest part or all of the amounts charged to the Participants. You agree that TribeUpp and the relevant Guest or Host will have no liability to you in respect of such cancellations or refunds. In the circumstance that a Host cancels their obligation to Host then TribeUpp is not liable to refund part or all of the amounts charged the other Participants.
